Regulatory enforcement action taken pharmacy personnel for non-compliance

The Pharmacy and Medicines Regulatory Authority (PMRA) hereby publishes recent regulatory enforcement action taken against five pharmacy personnel who faced disciplinary hearings for violating set regulatory standards.

The Authority, pursuant to Section 37 of the PMRA Act, 2019, commenced regulatory action against the five listed pharmacy personnel for alleged violation of relevant Pharmacy Laws, Regulations and the Pharmacy Code of Ethics.

Waiver on requirements for purchase of medical products from wholesalers

 Under Section 40 as read with Section 45 of the PMRA Act, 2019, no pharmaceutical business is allowed to sell or procure medical products without evidence of registration and renewal of the applicable license. Based on this provision, the Authority directed that, effective 1st April, 2025, all wholesalers should only sell medical products to pharmaceutical businesses upon production of PMRA generated receipt for the payment of 2025/2026 retention fees and a copy of 2024/2025 pharmacy business license. 

In implementing the above directive, the Authority has observed practical challenges facing pharmaceutical businesses emanating from delayed electronic dispatch of PMRA issued receipts to paid up clients. 

In view of this, the Authority is granting a waiver to licensed and retained pharmaceutical businesses allowing them to procure medical products from registered pharmaceutical wholesalers upon production of bank deposit slip. The wholesalers are, therefore, required to verify registration status of the pharmaceutical businesses in the updated pharmaceutical business registers as provided by the Authority. 

Please note that this waiver is only applicable to registered and retained pharmaceutical businesses and is valid for two months from the date of this notice. 

Meanwhile, the Authority is encouraging all paid up license holders who have not yet collected their annual licenses to make necessary arrangements for collection.
